Pre-purchase Legal
Report (Due diligence). Before
proceeding with the purchase of any property we carry out a full investigation
regarding the legal situation and provide the client with a detailed
report. We include details concerning:

Confirmation of ownership

Any active tenancy agreements

Confirmation that all community fees (where
applicable) and local council taxes (IBI) are paid up to date
-
Any debts or charges held against the property
-
Town Planning information
regarding the property.
All this information
together gives our clients a true reflection of the legal situation regarding
the property they are interested in purchasing, and in this way any unpleasant
surprises at a later date are avoided.
The official
documents obtained are:

The Title Deeds to the property
-
The Nota Simple from the
corresponding Land Registry

A report from the Town Planning department at the local Town Hall
b)
Purchasing contracts. This service includes all the paperwork
related to:
- The writing
and/or supervision of a private purchasing contract.
- The
preparation for the elevation of the private contract to an official document
to be signed before the Notary.
- Accompaniment
to the Notary on the day of completion.
- The
presentation of the new Deeds at the Land Registry to officially register the
new ownership.
- The payment
of the corresponding taxes from the purchase (IVA, ADJ or ITP accordingly).

a)
Application for NIE – National ID number for foreigners.
In order to buy a property in Spain it is essential that the purchaser
has an NIE. This can be applied for
through your local Spanish Embassy (see FAQs) or by contacting the lawyers at
ConsultiQ.es for them to make the application.
For this to be possible we need a copy of the client’s passport and also
the client must grant a Power of Attorney to one of our team. This can be
arranged from Spain or from England.
b) Securing a mortgage.
If the client requires a mortgage for the purchase of the property,
ConsultiQ.es can provide the details of a highly reputable and independent firm
of British mortgage brokers based in Valencia who will find you the best offer
available.
c) Legalisation and licences.
ConsultiQ.es also offers the option of legalising any irregular
situations with properties which the Pre-purchase Legal Report has
unearthed. For example perhaps an
extension to an original property, a swimming pool or an outbuilding which has
not been legally declared. In such
cases, ConsultiQ.es will study and establish whether it will be necessary to
start the procedure of legalisation with the local authorities or whether in
fact the legally required time according to local laws has passed for the property
to become legal. This will usually
require an official project approved and signed by an engineer or an
architect. ConsultiQ.es works closely with a team of engineers and architects who
will offer such services at a competitive price, also guaranteeing an efficient
service in order to facilitate the legalisation process.
d) Connecting the utilities
Where the Pre-purchase Legal Report had discovered that the property
purchased has no connection to water, electricity or gas, ConsultiQ.es can take
care of the paperwork involved in getting connected. For this to be possible the client will need
to be able to provide certain official paperwork for the property such as the Title
Deeds, Habitation Certificate or official electrical installation certificate.
